I see different things in this story...
On one side there is IBM - where probably, the fact of the patent wasn't a in the main stream (or they were not giving it up so easily), but pushed (again probably) by lawyers, themselves not that knowledgeable about history of email and features around it, but felt then need to protect the boss...
On the other hand there is the patent office, getting a large sum of money for do the search and all they do is to run a small software to lookup patent registry by keywords, but never step out to the real world - which actually render all the patenting system to a tool to bully creativity...
In any case, kudos to IBM to show the right way, when it became clear a patent is only for trolling...
